Abstrakt
Praca pt. „Konflikty społeczne na przykładzie referendum w gminie Kamienica” powstała jako dokumentacja i analiza sporu pomiędzy mieszkańcami gminy, jaki zaistniał gdy 15 inicjatorów rozpoczęło proces administracyjny, na mocy którego sołectwo Szczawa miałoby uzyskać status odrębnej gminy. Rada gminy oraz część mieszkańców okolicznych sołectw wyraziła swoje niezadowolenie w licznych protestach względem nowych granic. Sprawa ostatecznie rozstrzygnięta została w Wojewódzkim Sądzie Administracyjnym. Finalnie 22 września 2013 roku zostało przeprowadzone referendum.
Dalsza część odnosząca się do Jednostek Samorządu Terytorialnego omawia ich nową funkcję, wypracowaną w Rio de Janeiro w 1985 r. podczas uchwalenia Światowej Deklaracji Samorządu Terytorialnego, a w Polsce po reformie z 1989 roku. Obok samorządów opisane zostało społeczeństwo, które je stanowi. Oprócz ogólnej charakterystyki specjalnie poruszony został temat konfliktu społecznego jako kontekst różnych poglądów mieszkańców na kształt gminy Kamienica.
Druga część to ogólna charakterystyka gminy Kamienica oraz szczegółowe omówienie, nie tylko referendum, ale również dwóch wcześniejszych prób jego zorganizowania. Ukazana została procedura, jaką zastosowano od pierwszego pisma wystosowanego przez inicjatorów referendum do Wójta Gminy Kamienica przez wyroki Wojewódzkiego Sądu Administracyjnego w Krakowie oraz Naczelnego Sądu Administracyjnego w Warszawie, aż po przebieg i finalne wyniki referendum. Umieszczenie argumentów oraz ich kontrargumentów przedstawi strony społeczeństwa w konflikcie oraz próby jego rozwiązania.
Work "Social conflicts on the example of the referendum in the Kamienica municipality" was established as a documentation and analysis of the dispute between the residents of the municipality, which appeard when the 15 initiators started the administrative process by which the rural administrative unit Szczawa would get the status of the separate municipality. The municipal council and part of the inhabitants of the surrounding rural administrative units expressed their dissatisfaction in numerous protests with respect to new frontiers. The case eventually was settled in the Regional Administrative Court. September 22, 2013 referendum finally was conducted. Next part relating to the Units of Local Government was discussed including their new feature, developed in Rio de Janeiro in 1985, during the resolution of the Universal Declaration of Local Government, in Poland approved after the reform in 1989. After this time, the territory of Poland was founded around 2478 municipalities, which in addition to new frontiers received new powers of authority. In addition to self-described society that it is. The whole procedure was shown from the first letter sent by the initiators of the referendum to the commune administrator Kamienica by the judgments of the Regional Administrative Court in Kraków and the Supreme Administrative Court in Warsaw, and of course the final results of the referendum. Putting the arguments for the referendum and submit their counterarguments will show opinions of two parts of society in conflict and their attempts to resolve it.
