Notarialne poświadczenie dziedziczenia jako alternatywny sposób stwierdzania prawa do dziedziczenia

Abstract

Nowelizacja ustawy z dnia 24 sierpnia 2007 r. – Prawo o notariacie i niektórych innych ustaw wprowadziła do polskiego porządku prawnego instytucję notarialnego poświadczenia dziedziczenia. Jest to alternatywna - do sądowego stwierdzenia nabycia spadku - droga uzyskania dokumentu poświadczającego prawo do spadku. Idea wprowadzenia tej nowej instytucji odpowiada oczekiwaniom społecznym, umożliwiając szybsze przeprowadzenia wszelkich formalności związanych z uregulowaniem spraw spadkowych oraz uzyskaniem dokumentu potwierdzającego prawa do spadku. Dokument uzyskany u notariusza ma moc prawną z chwilą zarejestrowania aktu poświadczenia dziedziczenia w Rejestrze Aktów Poświadczenia Dziedziczenia Krajowej Rady Notarialnej, natomiast postanowienie sądowe dopiero z chwilą prawomocności. Korzystnie wpływa na funkcjonowanie sądów, odciążając je od spraw, które – jak w przypadku niespornych postępowań z definicji nienależących do szeroko pojmowanego sądowego wymiaru sprawiedliwości, ale stanowiących jeden z instrumentów ochrony prawnej. Szybsza możliwość uzyskania potwierdzenia praw do spadku ma także korzystny wpływ na inne toczące się postępowania sądowe i administracyjne, których dalsze prowadzenie jest uzależnione od wykazania praw do spadku po danej osobie. Oprócz możliwości szybszego – niż w przypadku drogi sądowej, gdzie konieczne jest wyznaczenie rozprawy, co wiąże się z oczekiwaniem na jej termin - sposobu załatwienia spraw spadkowych, dotychczasowi uczestnicy postępowania sądowego uzyskali także możliwość przeprowadzenia takiego postępowania na terenie całego kraju u dowolnego notariusza. Dotychczas możliwe to było w miejscu ostatniego zamieszkania spadkodawcy. Ma to ogromne znaczenie dla społeczeństwa, które staje się coraz bardziej mobilne. Osobiste stawiennictwo w sądzie, który jest oddalony setki kilometrów i w terminie, na który osoba zainteresowana nie ma wpływu, jest często problemem trudnym do pokonania. Celem niniejszej pracy jest przedstawienie notarialnego poświadczenia dziedziczenia, jako alternatywnej - do sądowej, drogi uzyskania potwierdzenia spadku oraz korzystania z tej instytucji w latach 2008-2011. Z przeprowadzonej analizy wynika, że ilość sporządzanych aktów poświadczenia dziedziczenia wciąż wzrasta, w 2011 roku stanowiły one już 24 % wszystkich spraw spadkowych, odciążając sądy. Analiza wskazuje, że wprowadzenie notarialnego aktu poświadczenia dziedziczenia było potrzebne i zasadne.

The amendment to the Act on Notarial Services law and to some other laws has introduced the institution of notarial authentication of succession to the Polish legal system. This is an alternative way of obtaining a document ascertaining the right of inheritance as required in the court of law in order to ascertain the acquisition of inheritance. The idea of having such an institution introduced meets the expectations of the society, which will mean streamlining of all formal procedures aimed at settling any and all hereditary matters and obtaining a deed of right to inheritance. A document from a notary public is legally bending upon its registration in the Register of Authenticated Acts, kept by the National Notary Association; instead, decisions adopted by the court of law are binding only when they become legally valid. This is also advantageous to the courts of law which no longer have to deal with matters being merely non-litigious procedures which by definition do not belong to the generally conceived judicial administration of justice, but are an instrument of legal protection. A faster track to the confirmation of one’s rights to inheritance will be also favorable for other pending judicial and administrative proceedings whose further course will depend on having one’s rights to inheritance from another person ascertained. While recoursing to the law, it is necessary to fix a date of the trial, which will also mean waiting for some time so as to have one’s inheritance matters settled; instead, the notarial authentication also means that the hitherto parties to the trial may henceforth apply to any notary public all over Poland and are no longer restricted to the place of the last residence of the devisor, which is of essential importance to the society that becomes more and more mobile. Compulsory appearance in the court building, often situated miles away, as well as the fixed date of trials beyond control of the party concerned is often an obstacle. This paper is aimed at showing the notarial ascertainment of inheritance as an alternative solution to the judicial procedure required for the confirmation of the inheritance and at enjoying such an institution in the years 2008-2011. According to the analysis it can be stated that the number of the ascertained deeds of inheritance has been increasing, and in 2011, they had a 24% share in all inheritance matters taken off the courts of law. The analysis corroborates the thesis that the introduction of the notarially ascertained deed of inheritance was useful and justified.
