Ustawodawstwo antykonkurencyjne nie jest przeciwne samej idei koncentracji i posiadaniu pozycji dominującej, ale sprzeciwia się jej wykorzystywaniu. Kontrola koncentracji określa zasady procesu łączenia i przejęć przedsiębiorstw, zapobiegające nadmiernej koncentracji gospodarki.
Celem niniejszej pracy jest uzasadnienie roli, jaką pełni kontrola koncentracji we współczesnym świecie oraz przedstawienie procesów kryjących się pod terminem koncentracja. Hipotezy badawcze, które zostały w tym celu poddane weryfikacji to:

The enterprise has always been faced with new challenges, demands and barriers as a result of the ever changing of business environment. As a consequence, companies have been forced not only to survive but to develop, implementing new management approaches and growing in order not to be left behind in the race. Competition in the market is taking on a new aspect due to the rapid process of globalisation and no business is able to face all the challenges alone, forcing mergers and acquisitions, in order to become more efficient and gain larger market share.
The concentration of enterprises is favoured by competition, which is seen as a necessary force in the business setting. Consolidation leads to market domination and is in-turn limiting the ever needed function of competition. The process of mergers and takeovers, and dominant position in a market are not seen as a negative aspects of an economic activity, but conducted without they can easily limit production, raise prices and as result lead to the confinement of a monopoly, that can be harmful for the economy. The fundamental barrier against excessive concentration and abuse of dominant position is the control of concentration which is overseen by the European Commission in the European Union.
