Sytuacja osób niepełnosprawnych na rynku pracy w Polsce na tle rozwiązań Unii Europejskiej

Abstract

Niepełnosprawność jest to jeden z ważniejszych problemów współczesnej zjednoczonej Europy. W Polsce problem ten dotyka przeszło 5,5 milionów Polaków. Prawa osób niepełnosprawnych są chronione przez zapisy zawarte w Konstytucji RP oraz ustawach zwykłych: o rehabilitacji zawodowej i społecznej oraz zatrudnianiu osób niepełnosprawnych. Pomimo tego istnieje szereg barier, które musi pokonać osoba niepełnosprawna na polskim rynku pracy. Powszechność tego zjawiska stawia przed państwem zadanie przeciwdziałania mu oraz zmniejszania jego skutków, dlatego państwo proponuje szereg mechanizmów które mają poprawić tę sytuację. Podobnie wygląda sytuacja osób niepełnosprawnych w krajach Unii Europejskiej. Działania wspólnotowe w tym zakresie realizowane są w większości na płaszczyźnie poszczególnych państw członkowskich – zmierzają do pełnej integracji osób niepełnosprawnych i ich aktywnego udziału w życiu społecznym jak i zawodowym. Status osoby niepełnosprawnej w krajach wspólnotowych umocnił Traktat z Lizbony zmieniający Traktat o Unii Europejskiej i Traktat ustanawiający Wspólnotę Europejską, co spowodowało wprowadzenie przez państwa członkowskie wielu rozwiązań wspomagających przełamanie barier na rynku pracy osób niepełnosprawnych. Analiza danych statystycznych dotyczących aktywności zawodowej osób niepełnosprawnych w Polsce na tle Unii Europejskiej nie stawia nas w korzystnym świetle. Dodatkowo badania potwierdzają, że na aktywność zawodową osób niepełnosprawnych mają niekorzystny wpływ także inne czynniki, takie jak: wiek, wykształcenie oraz miejsce zamieszkania. Aby poprawić tę sytuację Polska i pozostałe państwa członkowskie muszą podjąć działania w celu modyfikacji systemu wsparcia tej grupy na rynku pracy.

Disability is one of the most important issues of modern united Europe. In Poland this issue relates to more than 5.5 million Poles. The rights of the disabled are protected by the provisions in the Constitution of the Republic of Poland and ordinary acts: on vocational and social rehabilitation as well as on employing the disabled. Despite this, there are a number of barriers that a disabled person has to overcome on the Polish labour market. The commonness of this phenomenon sets for the state a task of prevention of it and decreasing its results, therefore, the state suggests a number of mechanisms that are to improve this situation. The situation of the disabled is similar in European Union countries. The activities of the Community within this scope in majority are executed on the plane of particular member states – they aim at full integration of the disabled and their active participation in the social as well as professional life. The status of a disabled person was reinforced in the countries of the Community by the Treaty of Lisbon amending the Treaty on the European Union and the Treaty establishing the European Community which enabled the member states to introduce many solutions supporting the breaking of the barriers on the labour market of the disabled. The analysis of statistical data regarding the professional activity of the disabled in Poland in the view of the European Union does not present us in a favorable position. Additionally, the researches confirm that upon the professional activity of the disabled also other factors have a negative effect, among others: age, education and place of residence. In order to improve this situation Poland and other member states must take actions to modify the support system of this group on the labour market.
