Podpis cyfrowy - aspekty prawne, informatyczne, techniczne

Abstract

Szybki rozwój technologii informatycznych jaki nastąpił w ciągu ostatnich kilku lat wpłynął znacząco na nasze życie. Nowe technologie są bodźcem rozwoju gospodarczego państw oraz społeczeństw. Problematyka pracy porusza szereg kwestii związanych z praktycznym zastosowaniem nowoczesnych technik komunikacyjnych. Publikacja poświęcona jest tematyce informatycznej oraz regulacjom prawnym uwierzytelnienia dokumentów elektronicznych za pomocą podpisu elektronicznego. Praca została podzielona na cztery aspekty: ogólnotematyczny, techniczno–organizacyjny, formalno-prawny, część czwarta stanowi porównanie technologii podpisu cyfrowego w Polsce oraz Estonii. Zasadniczą częścią pracy jest omówienie możliwych zastosowań technologii podpisu elektronicznego w życiu codziennym każdego obywatela kraju. Autor pracy postawił sobie dwa cele. Pierwszy z nich: praktyczno-dydaktyczny, polega na upowszechnieniu interesującej oraz zawiłej problematyki wykorzystania podpisu cyfrowego w obrocie prawnym, służącej do składania oraz przenoszenia oświadczenia woli drogą cyfrową. Cel drugi: teoretyczno-badawczy, polegał między innymi na porównaniu wykorzystania podpisu elektronicznego w Polsce i Estonii.

The rapid growth of information technologies that has taken place in the last couple of years has had a considerable impact on our lives. New technologies are stimulating the economic development of contemporary countries and societies. This thesis elaborates on a number of topics connected to practical applications of modern communication techniques. This work is devoted to the topic of information technology, as well as the legal regulations on the authentication of electronic documents via electronic signature. The thesis has been organized into four main parts: the general one, the technical and organizational, the formal and legal and, finally, the comparison of digital signature technologies in Poland and Estonia. The core element of this work is the outline of possible practical applications of e-signature technology in everyday life of any citizen. To sum up, the author’s intention was to present two main perspectives on the topic. First of all, within the practical and didactical part, an interesting and complex nature of esignature use in legal transactions serving the managing of declaration of will was described. The second aim was related to both, theory and research, and involved the comparison of electronic signature use in Poland and Estonia.
