Obszary Natura 2000 jako prawna forma ochrony przyrody w Polsce

Abstract

Przedmiotem mojej pracy będzie sieć Natura 2000 jako jedna z wielu form ochrony przyrody. Program ten choć związany z Unią Europejską został wdrożony do polskiego systemu prawnego. W moim opracowaniu będę starała się wytłumaczyć czym jest sieć europejska Natura 2000, zdefiniować takie pojęcia jak: obszar specjalnej ochrony ptaków, obszar specjalnej ochrony siedlisk i obszar mający znaczenie dla Wspólnoty, określę w jaki sposób są wyznaczane i jakie organy są za nie odpowiedzialne. W pracy przedstawiam krótki rys historyczny ukazujący prawną ochronę przyrody w Polsce, rozwój poszczególnych form ochronnych i ich obecny kształt. Koncentruję sie na aktach normatywnych, które zawierają regulujące dotyczące ochrony przyrody. Swoją uwagę skupiam również na konsekwencjach prawnych jakie niesie ( niosło) wdrożenie sieci Natura 2000 w Polsce, w szczególności oddziaływanie tej formy przyrody na zwykłych obywateli. Staram się doszukiwać instrumentów prawnych, mających na celu ochronę podmiotów, które w jakiś sposób z powodu wdrożenia programu Natura 2000 ucierpiały majątkowo. Końcowa cześć pracy poświęcona jest odpowiedzialności prawnej na obszarach Natura 2000, przedstawiając konsekwencje niedostosowania się podmiotów do reżimu prawnego tam panującego. Moja praca daje twierdzącą odpowiedź na pytanie - czy cel, który program Natura 2000 miał spełniać, został w Polsce spełniony.

The theme of my thesis is Environment Areas 2000 Project as one of many forms of environment protection. This project, although related to the European Union, has been implemented into the Polish legal system. In my study I attempt to explain the idea of the European network Natura 2000, define the terms, such as: an area of special protection of birds, an area of special protection of habitats and an area particularly important for the Union; I also describe the ways of marking these areas, and organs responsible for it. The thesis also renders a brief historical account of environment protection in Poland, the development of protection forms and their current status. I concentrate on normative acts which include the regulations pertaining to environment protection. Another focus is given to legal present (and past) consequences of the implementation of the Natura 2000 network in Poland, and in particular, the effect of this form of environment protection upon ordinary citizens. I try to analyse the legal instruments gearing to the protection of those entities which suffered damages due to the implementation of the Natura 2000 project. The closing part of the thesis deals with the legal liability on the Natura 2000 areas, presenting the consequences of legal disobedience to the laws to be observed on these areas. In conclusion, I provide the positive answer to the question – whether the objective of the Natura 2000 project in Poland has been fulfilled.
