Konkurencja przedsiębiorstw jest rywalizacją, której celem jest osiągnięcie tych samych celów o znaczeniu gospodarczym. Jednak „zasady” tej rywalizacji są ograniczone albo zupełnie niemożliwe w sytuacji, gdy jeden z podmiotów funkcjonujących na rynku jest monopolistą. Celem poniższej pracy jest szczegółowe omówienie zagadnień teoretycznych dotyczących konkurencji oraz nadużycia pozycji dominującej przez przedsiębiorstwa. Celem badawczym jest identyfikacja i analiza przejawów nadużywania pozycji dominującej przez dwa wybrane podmioty Grupa PKP S.A. oraz TP S.A w oparciu o wydane przez Prezesa UOKiK – decyzje nakładające kary finansowe na wspomniane przedsiębiorstwa. Kolejnym celem jest, także analiza jakości usług świadczonych przez wybrane podmioty mające pozycję dominującą na rynkach właściwych. Badanie oparte było na ankiecie. Wyniki potwierdziły hipotezę, że jakość usług oferowanych przez PKP S.A. oraz TP S.A. są na niskim, niesatysfakcjonującym poziomie. Nadużycie pozycji dominującej może w szczególności polegać na stosowaniu nieuczciwych praktyk cenowych, czy narzucaniu nieuczciwych warunków umów. Przepisy ustawy wymieniające przykładowe sposoby nadużycia pozycji dominującej, z uwagi na ogólny charakter, mogą być różnie interpretowane. Przedsiębiorcy posiadający pozycję dominującą, powinni zatem zachowywać szczególną ostrożność w ramach prowadzonej polityki rynkowej, aby nie narazić się na zarzut takiego nadużycia.
Main porpouse of subjected businessess in industry market are competition based on established market laws. Although these laws can easily be bended and forced by competitor who owns majority on the market. My work will then describe above arguments. Goal of this research will focus mostly on analysis of symptoms and aspects how monopolists overwhelm and use their position to dominate competition, taken two major examples from General Inspector for Consumers and Competition – PKP and TP S.A. - as these has been fined the largest penalty due to unfair practices against their market rivals. Next objective undertake in my work will study quality of service given by those major subjects. The general opinion of big companies can be much misleading despite fact how much funds they put into promoting themselves around and commercialising the brand. Actual surveys and questionnaires gives rather oposite effect - we can find out more than many examples of unsatisfactory customers and low levels of service. We can describe unfair practises such as using hidden charges, manipulate prices or hiding important information when negotiating contract. The statutes which gives strict directions how obey current law theoraticaly can be easily interpreted and as a matter of fact used in fraudelent way. Therefore any entrepreneur that hold leading position on market should have been more prudent and consider those facts when working within market policy to avoid further charges and not expose themselves to any allegations from that title.
