Samorząd terytorialny jest wyodrębnioną prawnie i organizacyjnie jednostką administracyjną.
Działa on na podstawie ściśle określonych, odrębnych ustaw i aktów, spośród których aktem
najwyższej rangi, związanym właśnie z funkcjonowaniem samorządu terytorialnego jest
Konstytucja Rzeczypospolitej Polskiej z dnia 2 kwietnia 1997 r. Ten oraz inne akty określają
ścisłe zasady funkcjonowania gminy jako jednostki terytorialnej, w tym te dotyczące budżetu
gminy. Samorząd terytorialny funkcjonuje na podstawie trzech wynikających z Konstytucji
zasadach: na zasadzie pomocniczości, zasadzie samodzielności oraz na zasadzie domniemania
właściwości samorządu terytorialnego. Istotnym elementem niezależności i samodzielności
jednostek samorządu terytorialnego jest ich samodzielność finansowa. Źródło dochodów

budżetowego. Zasady te można podzielić na dwie grupy: dotyczące treści i istoty budżetu
(zasada równowagi budżetowej oraz zasada zupełności budżetu), a także wiążące się
z konstrukcją budżetu i jego cechami zewnętrznymi (zasada jedności budżetu, zasada
szczegółowości budżetu, zasada jasności budżetu, zasada jawności budżetu). Gospodarka
budżetowa gminy jest objęta w całości planem budżetowym.
