Celem niniejszej pracy jest przybliżenie zjawiska mobbingu w miejscu pracy.
Zjawisko to staje się coraz powszechniejsze, szczególnie w dobie kryzysu i stwarza
coraz więcej problemów dla pracodawcy oraz zagrożeń dla pracowników. W celu
uregulowania kwestii prawnych mobbingu w Polsce w dniu 1 stycznia 2004 roku
weszła w życie nowelizacja kodeksu pracy.
Ponieważ omawiana w pracy problematyka ma charakter wieloaspektowy autor
próbuje wyjaśnić zjawisko, jego pochodzenie oraz wyszczególnić najważniejsze cechy.
Dodatkowo dużą uwagę poświęca aspektom prawnym omawianego zjawiska.
Zwrócono tutaj uwagę na różnorodne interpretacje definicji mobbingu,
przedstawiono cechy, przyczyny, rodzaje, fazy, formy, skutki i sposoby
przeciwdziałania temu negatywnemu problemowi. Autor przedstawia również regulacje
prawne mobbingu w Polsce i wybranych krajach należących do Unii Europejskiej
(Szwecja, Francja, Belgia, Hiszpania, Wielka Brytania i Włochy).
The purpose of this paper is to present the phenomenon of bullying in the
workplace. This phenomenon is becoming increasingly common especially in times of
crisis and creates more and more problems for the employer and the risks to workers. In order to settle the issue of legal harassment in Poland on 1 January 2004, the
amendment to the Labour Code. As discussed in labor issues is multifaceted author only trying to explain the phenomenon, its origin, and list the most important features.
In addition, much attention is paid the legal aspects of this phenomenon.
Here attention has been paid to a variety of interpretations of the definition of
bullying, presents the characteristics, causes, types, phases, forms, effects and possible solutions to the problem of negative. The author also presents bullying legislation in selected countries of the European Union (Sweden, France, Belgium, Spain, United Kingdom and Italy).
