Formy realizacji zamówień publicznych w jednostkach samorządu terytorialnego na przykładzie gminy Chełmiec

Abstract

Przedmiotem niniejszej pracy jest zbadanie funkcjonowania systemu zamówień publicznych na poziomie samorządu terytorialnego. W tym celu przeprowadzone zostały badania zamówień publicznych w gminie Chełmiec w latach 2008 – 2011. Na tej podstawie, zgromadzona została wiedza o inwestycjach realizowanych przez gminę, a także wiedza o trybach, jakie gmina stosowała w praktyce udzielania zamówień publicznych. W teoretycznej części pracy został krytycznie przeanalizowany stan prawny w dziedzinie zamówień publicznych. On właśnie decyduje o udzielaniu owych zamówień w istotnym stopniu. Zapoznanie się z praktyką udzielania zamówień publicznych w badanej jednostce samorządu terytorialnego pozwoliło mi na stwierdzenie, iż gmina stosuje jedynie dwie formy udzielania zamówień, jakimi są: przetarg nieograniczony oraz zapytanie o cenę. W większości przypadków stosuje się przetarg nieograniczony, ponieważ jest to jeden z dwóch trybów głównych, które ustawa „Prawo zamówień publicznych”, określa w swoich zasadach udzielania zamówień jako tryb podstawowy. Nie wymaga spełniania żadnych szczególnych przesłanek do stosowania. Gmina udziela zamówień również w trybie zapytania o cenę, jednak odbywa się to w bardzo niewielu przypadkach. Taki stan rzeczy jest być może komfortowy dla urzędu gminy, ale niekoniecznie służy on rozsądnemu wydatkowaniu publicznych pieniędzy. W pracy zostały sformułowane pewne wnioski dotyczące doskonalenia polskiego systemu zamówień publicznych.

The following thesis presents examination of the public procurement system functioning on the level of the local government. For this purpose, examination concerning public procurement in Chełmiec Commune between 2009 - 2011 has been held. On this basis, knowledge of investments realized by the commune has been collected as well as knowledge of procedures that the commune used in practice of public procurement awarding. In the theoretical part of the thesis, legal status concerning public procurement has been critically analyzed. Above mentioned legal status decides abort granting this procurement in a large extent. Getting familiar with the practice of granting public procurement in examined entity of the local government allowed me to conclude that the commune uses only two forms of awarding procurement, such as: open tender and request for quote. In the majority of cases, open tender is used because it is of the two main modes, which Act of „Public Procurement Law” determines in its principles of granting procurements as preliminary mode. It does not require compliance with any special conditions for usage. The Commune also grants procurement in the mode of request for quote, however it is done in a very few cases. This situation is perhaps comfortable for the Commune Office, but it is not necessarily a reasonable expenditure of public money. In the thesis some conclusions concerning improvement of public procurement system have been formulated.
