| dc.description.abstract | Celem pracy było zobrazowanie Trybunału Konstytucyjnego jako instytucji, która wydaje orzeczenia będące wynikiem kontroli zgodności ustaw z konstytucją. Przedstawiono go również jako organ mający istotny wpływ na polityczne procesy sprawowania władzy w Polsce. Przedstawiono rolę i znaczenie ustrojowe Trybunału Konstytucyjnego. Dokładnie omówiono zakres kompetencji Trybunału. Dokonano tego na postawie ustawy z dnia 1 sierpnia 1997 r. o Trybunale Konstytucyjnym. Niniejsze opracowanie opiera się na aktach normatywnych i obszernej literaturze z zakresu prawa konstytucyjnego. Wykorzystano również publikacje sejmowe, Trybunału Konstytucyjnego oraz strony internetowe. Na podstawie tych źródeł trafnie wybrano metodę analizy opisowej, aby rzetelnie opracować temat i zrealizować cel pracy. Szczegółowej analizie i interpretacji poddano dwie wybrane sprawy i kończące je postanowienia Trybunału. Pierwsza dotyczyła umorzenia postępowania w sprawie skargi konstytucyjnej, a druga odmowy nadania skardze dalszego biegu. Powodem odmówienia pierwszej jej kontynuacji był brak orzeczenia ostatecznego, które jest podstawowym warunkiem wniesienie skargi do Trybunału. Drugiej odmówiono dalszego rozpatrzenia z kilku powodów, a w szczególności chodziło o błędne określenie podstawy skargi. Gruntownie opisano przebieg rozpoznania wniosków. Przedstawiono motywy sentencji. Na koniec porównano obie skargi i przedstawiono najważniejsze problemy związane ze skargami w Trybunale. Przegląd postanowień pozwolił dowieść, że procesu orzekania przebiegł sprawnie i efektywnie choć niekorzystnie dla skarżących. | pl |
| dc.description.abstract | The aim of this study was to illustrate the Constitutional Court as an institution that gives rulings as a result of the conformity of laws with the Constitution. It presents it also as a body that plays a significant influence on the political processes of governance in Poland. Presented the role and importance of government the Constitutional Court. The book examines the competence of the Court. This was done on the basis of the Law of 1 August 1997. Constitutional Tribunal. This study is based on the normative acts and the extensive literature in the field of constitutional law. Also used parliamentary publications, the Constitutional Court and websites. Based on these sources aptly descriptive analysis method was chosen to reliably develop a theme and achieve the aim. Detailed analysis and interpretation were the two selected cases, and terminating them order of the Court. The first concerned the discontinuance of the proceedings on the constitutional complaint, and the second refusal to act on the complaint. The reason to deny first its continuation was the lack of final judgment, which is a precondition for bringing an action before the Court. The other was denied further consideration for several reasons, in particular it was about erroneous determination of the complaint. Thoroughly described the course of dealing with the requests. Presented ruling motives. At the end compared to both the application and presents the most important issues relating to the complaints to the Tribunal. Overview of provisions allowed to prove that the adjudication process ran smoothly and efficiently while negative for applicants. | pl |
