Warunki prawne transplantacji ex vivo w Polsce

Abstract

Artykuł stanowi analizę prawnych warunków transplantacji ex vivo w Polsce, kładąc nacisk na kwestię ochrony dóbr dawcy oraz granice legalności tego rodzaju procedur medycznych. Opracowanie ma na celu przedstawienie specyfiki przeszczepów od żywych dawców na tle aktualnych regulacji polskiego prawa medycznego. Opracowując tekst, posłużono się metodą dogmatyczno-prawną, polegającą na analizie aktów normatywnych i literatury przedmiotu. Wykazano, że transplantacje ex vivo odznaczają się podwyższonym rygoryzmem prawnym, zaś ich legalność uzależniona jest od spełnienia licznych przesłanek formalnych, materialnych i proceduralnych.The article is an analysis of the legal conditions of ex vivo transplantation in Poland, emphasizing the protection of the donor's goods and the limits of the legality of this type of medical procedures. The study aims to present the specificity of transplants from living donors against the background of current regulations of Polish medical law. When preparing the text, the dogmatic-legal method was used, consisting in the analysis of normative acts and literature on the subject. It has been shown that ex vivo transplantations are characterized by increased legal rigor, and their legality depends on the fulfillment of numerous formal, material and procedural conditions.
