Abstrakt
To drugi artykuł dedykowany instytucji odpowiedzialności prawnej osób sporządzających certyfikaty energetyczne budynków. Tym razem poruszono w nim temat odpowiedzialności cywilnej sprzedającego świadectwo energetyczne względem kupującego z tytułu rękojmi za wady. Posługując się wnioskowaniem prawniczym jego autor wyjaśnia użycie przez ustawodawcę terminu „należyta staranność” oraz podkreśla to, że certyfikaty energetyczne budynków zawierające nieprawdziwe informacje o wielkości energii są wadą fizyczną w rozumieniu Kodeksu cywilnego. We wnioskach końcowych akcentuje kwestię pozbawienia uprawnień do wydawania świadectw energetycznych w wyniku sporządzenia wadliwego świadectwa energetycznego i wyjaśnia, że będzie ona rozpatrywana przez pryzmat udowodnienia nie przestrzegania zasad należytej staranności.
This is the second article addressing the legal liability of professionals who prepare the energy performance certificates. It focuses on the seller's civil liability toward the purchaser, specifically regarding the warranty against defects. Through legal reasoning, the author explains the legislator's use of the term "due diligence" and emphasizes that the energy certificates containing inaccurate information regarding energy consumption constitute a physical defect within the meaning of the Civil Code. In the final conclusions, he highlights the potential revocation of the authorization to issue the energy certificates as a result of the preparation of a defective certificate and explains that it will be assessed through the lens of proving a failure to observe due diligence standards.
