Świadectwo energetyczne w postępowaniu administracyjnym

Abstract

Artykuł ten jest jednym z trzech, odnoszących się do charakteru prawnego świadectwa energetycznego. Wyeksponowano w nim rolę certyfikatu energetycznego w procesie budowlanym i podkreślono doniosły charakter publiczno – prawny tego rodzaju dokumentów. Wyjaśniono, że jako instytucja materialnego prawa administracyjnego świadectwo charakterystyki energetycznej stanowi istotny element wspólnotowej polityki ochrony środowiska i bezpieczeństwa energetycznego. Nawiązując do przepisów Kodeksu postępowania administracyjnego, przeprowadzono wywód pod kątem znaczenia świadectwa energetycznego w kontekście jego mocy dowodowej w postępowaniu administracyjnym oraz odpowiedziano na pytanie, czy taki certyfikat jest dokumentem urzędowym, prywatnym czy może jednak powinien być zaliczany do grupy „swoistych dokumentów Prawa budowlanego".The article is one of three addressing the legal nature of the energy performance certificate. It highlights the role of the energy certificate in the construction process and emphasizes the significant public-law character of such documents. It explains that, as an instrument of substantive administrative law, the energy performance certificate constitutes a vital element of the Community’s environmental protection and energy security policies. Referring to the provisions of the Code of Administrative Procedure, the article analyzes the significance of the energy certificate in terms of its evidentiary value in administrative proceedings and answers the question of whether such a certificate constitutes an official document, a private document, or perhaps a document belonging to the category of "specific type of documents of Construction Law".
