| dc.description.abstract | Celem niniejszej pracy było omówienie problemu egzekucji świadczeń alimentacyjnych stanowiących szczególny rodzaj egzekucji świadczeń pieniężnych, traktowanych odrębnie w odniesieniu do ogólnych przepisów o postępowaniu egzekucyjnym. Dyktowane jest to bowiem względami humanitarnymi i społecznymi, mającymi przyspieszyć oraz uskutecznić przeprowadzenie procesu egzekucji alimentów. Badania konstruowane były w oparciu o obowiązujące przepisy kodeksu postępowania cywilnego, ustawy o komornikach sądowych i egzekucji oraz ustawy o pomocy osobom uprawnionym do alimentów. Praktyka sądowa wskazuje, iż osoby uprawnione do alimentacji mają problem z egzekwowaniem przyznanych im należności. Powstanie funduszu alimentacyjnego jest alternatywą wspierającą pozyskiwanie świadczeń w przypadku kiedy egzekucja z majątku dłużnika jest bezskuteczna. Konieczne staję się opracowanie rygorystycznych i klarownych przepisów regulujących egzekucję alimentacyjną. | pl |
| dc.description.abstract | The purpose of this thesis is to discuss about the problem of execution of maintenance benefits which are the special kind of execution of cash benefits, treated separately with reference to the general rules of enforcement proceedings. This matter is related to humanitarian and social considerations that are intended to speed up and clarify conducting the process of the execution of maintenance. All hypotheses were constructed on the basis of code of civil procedure, law enforcement and judicial officers and also acts on assistance to person entitled to alimony. The judicial experience shows that persons entitled to the maintenance have problems with enforcement their payment due. The formation of the maintenance fund is an alternative supporting getting benefits when the execution from the debtor’s wealth is fruitless. It is necessary to work out rigorous and clear rules regulating the maintenance execution. | pl |
