Abstrakt
Artykuł odnosi się do braku konsekwencji polskiego ustawodawcy, który nie wprowadził do ustawy Prawo budowlane żadnych sankcji za brak posiadania świadectwa energetycznego. Podkreślono w nim to, że cele dyrektywy w sprawie charakterystyki energetycznej budynków, dotyczące zagwarantowania przez każdy kraj UE przygotowania świadectwa charakterystyki energetycznej w postępowaniu związanym z wznoszeniem, wynajmem i zbyciem nieruchomości zostały wyraźnie określone zarówno w preambule, jak i w samych przepisach tego unijnego aktu prawnego. W przypadku polskich rozwiązań prawnych wystarczyło zastosować wykładnię rozszerzającą i uwzględniając cele dyrektywy postanowić, iż w kwestii obowiązku posiadania świadectw charakterystyki energetycznej te same zasady należy stosować do budynków zarówno na rynku pierwotnym, jak i wtórnym. The article addresses the inconsequence of the Polish legislator, who didn't introduce any sanctions into the Construction Law Act for the absence of an energy performance certificate. It highlights that the objectives of the Energy Performance of Buildings Directive – specifically the requirement for every EU country to the preparation of an energy performance certificate during the building proceeds, rental, and sale of real estate - are clearly defined in the preamble and the provisions of this EU legal act. Regarding Polish legal solutions, it would have sufficed to apply an expansive interpretation and, taking into account the Directive’s objectives to decide that the same rules concerning the obligation of possess the energy performance certificates should apply to buildings on both real estate markets – the primary and secondary.
