Abstrakt
Jednym ze sposobów, w jaki obywatele mogą wpływać na decyzje i działania
podejmowane przez władze publiczne, jest włączanie się przez organizacje społeczne
w postępowanie administracyjne w sprawach mieszczących się w zakresie działalności
statutowej danej organizacji lub gdy przemawia za tym interes społeczny. Przepisy prawa
umożliwiają organizacjom pozarządowym udział w postępowaniach sądowych
i administracyjnych.
Główny problem badawczy, któremu poświęcona jest niniejsza praca, to analiza
konstrukcji prawnej udziału organizacji społecznych w postępowaniu administracyjnym
z uwzględnieniem różnych form, w jakich mogą w nim wystąpić. Przeprowadzona analiza
wykazuje, iż uprawnienia jakie przepisy prawa, zawarte w kodeksie postępowania
administracyjnego przyznają organizacji społecznej, dają jej możliwość realnego wpływu na
rzeczywistość. Zaprezentowane przykłady udziału organizacji ekologicznej w postępowaniu
administracyjnym potwierdzają te szerokie uprawnienia. Przykłady te wskazują, iż
organizacje społeczne coraz częściej korzystają ze swoich uprawnień dotyczących udziału
w postępowaniu administracyjnym.
One of the ways in which citizens can influence the decisions and actions taken by public authorities, is the involvement of the social organizations in the administrative proceedings on matters within the scope of statutory activities of the organization, or if it is in the public interest. The law allows non-governmental organizations to involve in judicial and administrative proceedings. The main research problem, to which this work is dedicated, is the analysis of the legal structure of social organizations and their participation in the administrative proceedings, taking into account the various forms in which it can occur. The analysis shows that the powers that the law contained in the Code of Administrative Procedure confer social organizations, give them the opportunity of real influence on reality. Presented examples of the participation of the environmental organizations in the administrative proceedings confirm these broad powers. These examples show that social organizations are increasingly using their rights for the participation in the administrative proceedings.
