Ochrona dóbr kultury w systemie ochrony ludności – uwagi na tle nowych regulacji prawnych

Abstract

Artykuł podejmuje problematykę ochrony dóbr kultury w sytuacjach kryzysowych w świetle dwóch kluczowych aktów prawnych: ustawy o ochronie zabytków i opiece nad zabytkami oraz ustawy o ochronie ludności i obronie cywilnej z 2024 r. Celem opracowania jest analiza wzajemnych relacji pomiędzy tymi regulacjami oraz ocena, czy nowa ustawa tworzy spójny system ochrony dóbr kultury jako elementu bezpieczeństwa publicznego. Autorka dowodzi, że ochrona ludności i ochrona dziedzictwa kulturowego nie stanowią odrębnych obszarów działań administracji publicznej, lecz są wzajemnie powiązanymi zadaniami publicznymi, realizującymi konstytucyjne wartości ochrony życia, bezpieczeństwa oraz tożsamości kulturowej.The article addresses the issue of safeguarding cultural heritage in crisis situations in the context of two key legal acts: The Act on the Protection of Monuments and the Care of Monuments, and the 2024 Act on Civil Protection and Civil Defense. The aim of the study is to analyze the interrelations between these regulations and to assess whether the new act establishes a coherent system for the protection of cultural heritage as an element of public safety. The author argues that the protection of the population and the protection of cultural heritage do not constitute separate areas of public administration activity, but are mutually interconnected public tasks that implement constitutional values of safeguarding life, security, and cultural identity.
