The article addresses the issue of the flawed transposition of the Energy Performance of Buildings Directive into the Polish legal system. It puts forward proposals for future regulations governing the operation of energy performance certificates in Poland. The author proceeds from the premise that these proposals will help the rational legislator avoid further missteps in drafting legal provisions. In his opinion energy performance certificates should to serve as a true indicator of energy efficiency of buildings. Therefore, Construction Law should impose rigorous requirements on these documents – particularly regarding their preparation based on an on-site inspection of the facility and their compilation with due diligence by independent experts.
