Abstrakt
Celem pracy było zidentyfikowanie oraz analiza barier administracyjnych występujących w działalności przedsiębiorstw w Polsce, a także ocena skuteczności współczesnych inicjatyw deregulacyjnych podejmowanych przez administrację publiczną. W pracy przeanalizowano wpływ regulacji administracyjnych na funkcjonowanie przedsiębiorstw, ze szczególnym uwzględnieniem sektora mikro, małych i średnich przedsiębiorstw. W części teoretycznej przedstawiono istotę barier administracyjnych, ich rodzaje, źródła oraz konsekwencje dla przedsiębiorców. Omówiono również zagadnienia związane z procesem stanowienia prawa gospodarczego, jakością regulacji oraz rolą administracji publicznej w kształtowaniu warunków prowadzenia działalności gospodarczej. Ponadto dokonano analizy wybranych inicjatyw deregulacyjnych realizowanych w Polsce oraz przedstawiono rozwiązania stosowane w Danii, Estonii, Kanadzie i Nowej Zelandii. W części empirycznej wykorzystano metodę sondażu diagnostycznego. Badanie przeprowadzono wśród 111 przedsiębiorców prowadzących działalność gospodarczą w Polsce. Analiza wyników wykazała, że najistotniejszymi barierami administracyjnymi są obciążenia związane z przepisami podatkowymi, składkami na ubezpieczenia społeczne, częstymi zmianami prawa oraz trudnościami interpretacyjnymi wynikającymi z niejednoznaczności regulacji. Respondenci wskazywali również na znaczące koszty czasowe związane z realizacją obowiązków administracyjnych oraz konieczność korzystania z usług księgowych i prawnych. Przeprowadzone analizy pozwoliły stwierdzić, że pomimo podejmowanych działań deregulacyjnych przedsiębiorcy nadal odczuwają istotne obciążenia administracyjne. Wyniki badań wskazują, że skuteczna deregulacja wymaga nie tylko ograniczania liczby obowiązków formalnych, lecz także poprawy jakości stanowionego prawa, większej stabilności regulacyjnej, dalszej cyfryzacji administracji publicznej oraz integracji systemów elektronicznych wykorzystywanych przez przedsiębiorców.
The aim of this thesis was to identify and analyze administrative barriers affecting business operations in Poland and to assess the effectiveness of contemporary deregulation initiatives implemented by public administration. The study focused on the impact of administrative regulations on business operations, with particular emphasis on micro, small, and medium-sized enterprises (SMEs). The theoretical part of the thesis presents the concept of administrative barriers, their types, sources, and consequences for entrepreneurs. It also discusses issues related to the process of economic lawmaking, the quality of regulations, and the role of public administration in shaping the business environment. Furthermore, selected deregulation initiatives implemented in Poland were analyzed and compared with solutions adopted in Denmark, Estonia, Canada, and New Zealand. The empirical part of the study employed a survey-based research method. The research was conducted among 111 entrepreneurs operating in Poland. The results revealed that the most significant administrative barriers are related to tax regulations, social security contributions, frequent legal changes, and difficulties in interpreting ambiguous regulations. Respondents also indicated considerable time costs associated with fulfilling administrative obligations and the necessity of using accounting and legal services. The conducted analyses indicate that despite the implementation of various deregulation measures, entrepreneurs continue to experience significant administrative burdens. The findings suggest that effective deregulation requires not only the reduction of formal obligations but also improvements in legislative quality, greater regulatory stability, further digitalization of public administration, and better integration of electronic systems used by entrepreneurs.
